Again, as is with federal policies and regulations, the conditions under which data is acquired, managed, and shared are regulated by various University policies. University policies that identify requirements under federal policies can be found on the Office of Research Development Web Site:

Freedom of Information Act Requests
This is the main thing to know: If you receive a FOIA request for information of any kind, notify the University Attorney or the Provost. Do not respond until advised to do so.

Federally funded projects are subject to the Federal Freedom of Information Act under
OMB Circuluar A-110, Section 36. EMU is also subject to the Michigan Freedom of Information Act. Although it may be necessary to provide some data to the requester, other data may be exempt from disclosure.
The rules are complex and change from time to time, and it is impractical for everyone to become an expert in these rules. Therefore, all EMU personnel who receive a FOIA request should promptly notify the University Attorney or the Office of the Provost and defer any action until receiving their advice.
